TERMS (Revised 23.09.18) Your order, and your place in the waiting list, is secure on receipt[1] of a booking deposit, which includes the non-refundable part of your deposit (see below). For orders scheduled for delivery in less than 18 months, the deposit is 50% of the final cost. In the event that the final cost has not yet been negotiated, an approximate 50% down-payment is sufficient. For orders scheduled for delivery more than 18 months after the order date, a 500 euro booking deposit will secure your place in the waiting list. Just prior to work commencing on your order, you will be asked for a 50% pre-payment if you have not already remitted it. Please set aside funds for this ahead of time, to avoid delay. In the event of delay your delivery time may be subject to renegotiation. Some of the terms below cover situations which I hope will not ever happen. I include them for your benefit and protection, to make it clear what the policy is. If you change your order at any time, the estimated completion date may change as a result, as well as the price, so these changes must be negotiated mutually before a change is made. Changes made to an order after work has begun may cost more, for instance if partially completed work must be re-executed as a result. If I am unable to complete your order within six months of the estimated completion date, and we cannot agree on a revised completion date, I agree to give a full refund for any items which you have not received. If you have been unable to contact me via telephone or email, I will refund on receipt of a written (mailed) refund request. If you've taken partial delivery already, then I will refund any pre-payment you have made for outstanding items. If your order is cancelled prior to the commencement of work, a booking fee will be retained up to a maximum of 200 euro, at my discretion, and the remainder of your deposit refunded. I will endeavour to let you know via email or telephone approximately 30 days before your order is complete. I will ship your completed order on receipt of the balance due, including estimated shipping costs. If you are unable to pay for your set within 30 days of its completion date, I reserve the right to re-sell the set. In this event I will keep a minimum of 200 euro of your deposit as non-refundable, plus any losses or discounts which I apply to speed re-sale, up to a maximum of 500 euro, and refund the rest of your deposit. Certain special-order items may require larger non-refundable deposits, which will be communicated when the order is being finalized. I will send a receipt with your completed order. If you need a printed invoice or deposit receipt, please ask. WARRANTY/REPAIR POLICY A set of pipes should last more than a lifetime, with proper care and maintenance. Certain parts[2], for instance reeds, leather parts, and thread-wrapped joints, are perishable and may require periodic replacement as a matter of course. However, because of the nature of the pipes, the natural materials of which they are made, and their sensitivity to climate conditions, I cannot warrant reeds or wooden parts, particularly those which are shipped overseas. As an exception to this, if an item is delivered to the customer in good condition but fails catastrophically within 60 days (signalling a hidden materials defect), I will replace it free of charge, except in cases of accident or misuse. (If an item is damaged in shipping, this is a matter for shipping insurance claims. Please don't send items to me without prior notification, and do not send items uninsured unless you are willing to accept responsibility for the risk of damage.) IMPORTANT NOTICE for customers OUTSIDE THE EUROPEAN UNION (EU): Due to importation policies which apply to all goods entering the European Union, I can provide only limited after-sales service to non-EU customers. Please be advised that all collection and repair work for customers outside the EU requires that the customer, or the customer's direct agent, personally deliver and collect the instruments and parts thereof from the Republic of Ireland. Any instruments sent via post, courier, or commercial delivery service will be subject to a 25% charge on the TOTAL VALUE of the item due to the imposition of V.A.T. on importation by Irish Revenue and Customs, which I must pass on to the customer. This of course renders these after sales services impractical. I regret that this is the case, and am continuing to try to find a suitable means of re-importing items for repair. In all cases I will endeavor to work with you to resolve issues which arise with your set. Where normal maintenance is concerned, I cannot provide all services free of charge, but I will work to provide any needed repair services to remedy occasional accidental damage that may occur during the lifetime of the pipes at reasonable charges, on a relatively timely basis. This means that I reserve time in my pipemaking schedule to deal with such repairs. Please do not make permanent modifications of any kind to your pipes without first consulting with me. I can't give refunds or exchanges for such items for any reason, so if you have a problem with any part of your set, please contact me directly. Normal reed adjustments are fine, as long as you understand that I cannot exchange reeds which have been permanantly altered by you. Likewise, if repair is necessary, please contact me so that I can either arrange to either make the repair myself, or arrange for the repairs to be carried out by someone agreeable to both of us. I reserve the right to refuse maintenance or repair work on sets which have undergone unauthorized modifications or repairs. [1] By "receipt of payment" here and below, I mean the date when the payment funds have cleared our various banks. Electronic transfers can take a week or more, checks may take longer. [2] In addition to the above list, tacked or stapled bellows may be considered perishable, whereas stitched bellows can be re-leathered successfully.
